Census Bureau Scare Tactics

The Washington Times recently covered Rep. Michelle Bachmann's vow to not complete next year’s national census due to concerns that include the potential of ACORN door-to-door information collection efforts. The piece notes the Congresswoman stating that “the Constitution doesn’t require any information” other than “how many people are in (her) home.”

Shelly Lowe, a spokeswoman for the U.S. Census Bureau, was quoted saying that Rep. Bachmann is "misreading" the law. Lowe also apparently sent “a portion of the U.S. legal code that says anyone over 18 years of age who refuses to answer ‘any of the questions’ on the census can be fined up to $5,000.”

This is quite laughable at many levels, as Lowe seems to not recognize the difference between the United States Constitution and statutory law. Perhaps she is a victim of a pandemic that has swept federal bureaucrats into believing that all laws, rules, and regulations are explicitly constitutional.

Let’s see whether she’s right. According to Article I, Section II, “The actual Enumeration shall be made within three years after the first meeting of the Congress of the United States, and within every subsequent term of ten years, in such manner as they shall by law direct.”

In light of this, should any reasonable person assume that there is a constitutional rationale to include areas of demography other than a headcount of constituents? I fail to see a basis upon which to ask questions regarding age, gender, race, nationality, socio-economic status, marital status, sexual orientation, hobbies, favorite NFL team, etc., for the exclusive purpose of congressional districting (no vested interest or conflict regarding ACORN’s involvement, of course).

The Times notes that Lowe claimed that the Congresswoman was “misreading the law;” however, Bachmann didn’t claim to have read “the law.” She only made mentioned of that which is she is constitutionally obligated to respond to.

“The law” is 13USC221, which by the way only states that anyone over the age of 18 who refuses to answer census questions “shall be fined not more than $100.” One who “willfully gives any answer that is false, shall be fined not more than $500.”

Where is Lowe’s $5,000 fine mentioned? Oh, here it is. The bureau’s FAQ site claims that 18USC3571 and 18USC3559 “in effect amends (sic)”13USC221 “by changing the fine for anyone over 18 years old who refuses or willfully neglects to complete the questionnaire or answer questions posed by census takers from a fine of not more than $100 to not more than $5,000.”

The bureau is utilizing scare tactics to make one think that Title 18, which refers to maximum sentencing and fines for any potential federal felony, misdemeanor, or infraction actually amends that which has indeed not been amended and is fully intact under 13USC221. Just look at how loose the language is and notice how it only appears as an answer to an FAQ and is not codified as law anywhere. If you don’t believe me, search Title 18 all you want.

On a side note, allow me to point out that 13USC221 also states that “no person shall be compelled to disclose information relative to his religious beliefs or to membership in a religious body.” Good to see that the bureau is required to respect at least some degree of our privacy.

Whether I am part of the sample for the ongoing American Community Survey or the 2010 Census, which will be mailed to every U.S. household in March, I plan to echo Congresswoman Bachmann’s stance, and will only answer that which I am constitutionally obligated to provide a response for. If I face a mere $100 fine, so be it. Privacy is well worth it.

Such an incredible day here in Phoenix as we are currently embraced by the warmth of The One. The sky seems more blue. The songs of the birds sound sweeter. Even the tap water is delightful. I in fact feel a thrill running down my leg. Oh wait – I just pissed myself. Oh well. Even urine smells sweeter when we are blessed by the presence of Obamessiah!

Hannity & Combs - The new Sean & Sean

As we will soon embark upon Alan Colmes' departure from the infamous Hannity & Colmes, a new liberal must be vetted to fill Alan's shoes. I would impore News Corp to deeply consider Sean John Combs (Puff Daddy, P. Diddy, Diddy and Puffy and Puff Diggity Diddly Doggly Daddy, and Puffy BALLZ!) for the job. Just think of all of the new potential contributors that FOXNews could entertain as a result. Whether it's Kanye "George Bush Does Not Care About Black People" West or yet another immaculate resurrection of Tupac Shakur, old man Rupert has nothing but vast opportunity to garner from such a decision.

Well the campaign "promises" are gone, now we have a tabula rasa, so what’s the real agenda?

Over the weekend President-elect Barack Obama scrubbed Change.gov, his transition Web site, deleting most of what had been a massive agenda copied directly from his campaign Web site.

Gone are the promises on how an Obama administration would handle 25 different agenda items - everything from Iraq and immigration to taxes and urban policy - all items laid out on his campaign Web site, www.BarackObama.com.

Instead, the official agenda on Change.gov has been boiled down to one vague paragraph proclaiming a plan “to revive the economy, to fix our health care, education, and social security systems, to define a clear path to energy independence, to end the war in Iraq responsibly and finish our mission in Afghanistan, and to work with our allies to prevent Iran from developing a nuclear weapon, among many other domestic and foreign policy objectives.”

“We are currently retooling the Web site,” said Obama spokesman Nick Shapiro.

The site went active on Wednesday and was available to the public Thursday. The agenda items, which were active for at least part of the weekend, appear to have been deleted by late Saturday.

A Message to Arizona Republican Voters

Thank you to all of those who went out and voted for McCain as well as your fellow Republican candidates for the house, state legislatue, county and local governments, and for conservative stances on the propositions (especially 102, which won by a landslide!).

We won Arizona for Sen. McCain and gave him our 10 electoral votes; hence Obama votes in our state were futile. The mainstream media and Hollywood did their part on the nationwide scale in ushering Obama to the White House.

Our nation probably deserves Obama, given where we have gotten. Far too many citizens depend on government rather than taking responsibility and rising above their situations, hence they looked to "change." We can only imagine where this will actually get them. Being stuck on further generational welfare vis a vis increased socialism is change in the wrong direction.

Look forward to 2010, as we have the opportunity to regain a majority in both chambers of Congress as we did in 1994 after two years of Bill Clinton. Our nation will regret the choice that they made today. The blind will have their eyes opened to a horrific state of affairs that have been brought forth by today's election.

Look forward to 2012 (1461 days) when we will have the opportunity to nominate and elect true conservatives who will get this nation back on her feet.

We are the party of Goldwater and Reagan; however, we seem to have forgotten that in recent years, especially as we get disheartened by corrupt members of our party, such as Sen. Ted Stevens, Sen. Larry Craig, and Rep. Mark Foley.

As the party neglects its conservative base, it loses elections. We must remember our roots.

This is not the end. It is only the beginning. It is a wake up call that we need to fight rather than be apathetic. We need to be vocal rather than "politically correct." We need to be vigilant rather than blinded. We are the true America, and we will prevail!

Obama returns aunt's donation after illegal immigrant report

So Obama states that he hasn’t had a close relationship with his aunt and that they haven’t been in close touch, hence he was not aware of her citizenship status.

This begs a few questions:

1) Shouldn’t the Obama campaign have vetted any of his relatives living in the US?

2) If they took such an effort and realized that she was an illegal immigrant, couldn’t a United States Senator pull a few strings to quietly get Onyango her citizenship?

3) If Obama cannot maintain a close relationship with his aunt and be in close touch with her, how can any Obama supporter feel that he will be in touch with their needs?

His illegal aunt lives in a Boston slum. Obama cannot help out his relatives with his power, and I am be now means confident that he can help the average American citizen.

Barack Obama's White House campaign said Saturday it was returning a small donation from his Boston-based Kenyan aunt after questions were raised over her US immigration status.

Aides said Obama had not been in touch with his late father's sister, Zeituni Onyango, 56, for at least four years, and questioned reporting about her residency status so close to Tuesday's election against Republican John McCain.

Obama spokesman Ben LaBolt said the campaign was returning 265 dollars donated by the aunt to her nephew's White House bid.

Foreigners cannot donate money to US presidential candidates. But aides refused to say whether returning the money was an acknowledgement that the aunt was an illegal alien.

"Given the information that has been brought to our attention, the contributions are being refunded," LaBolt said in a statement, without elaborating.

Obama's chief strategist David Axelrod would not comment on the aunt's immigration status but said Obama last met her for sure at his Senate inauguration ceremony in 2004.

"It's not a real close relationship. They have not been in close touch," he told reporters after Obama addressed 15,000 supporters in Henderson, Nevada.

Axelrod ascribed ulterior motives to the revelations after The Associated Press reported that Onyango had remained living in Boston despite having her request for asylum rejected by an immigration judge four years ago.

"The American people are pretty suspicious of things that are dumped in the marketplace 72 hours out from election day," the top aide said.

In a separate statement, Obama spokesman Bill Burton said: "Senator Obama has no knowledge of her status but obviously believes that any and all appropriate laws be followed."

The Immigration and Customs Enforcement refused to confirm or deny the report about Onyango, who is part of a large extended family on Obama's father's side spread across Kenya, the United States and Europe.

"We do not discuss the details of any individual's status or their case," ICE spokeswoman Kelly Nantel in Washington told AFP.

In Which Hospital Was Obama Born?

I implore everyone to ask as many Obama supporters as possible between now and next Tuesday, “In which hospital was Barack Obama born?” and see where the discussion leads.

For those of you who aren’t aware, discussion has been raised in regard to whether Obama was indeed born in Hawaii, or perhaps Kenya or Indonesia, which of course would make him ineligible to be our president under Article II, Section I of the Constitution. This was promulgated by Philip J. Berg, Esq in his law suit against the Senator. Yes, it was thrown out by the judge in the Eastern District of Pennsylvania, solely due to the fact that Berg lacked standing. No judicial opinion was made in regard to the merit of the case. Berg has since filed writ of certiorari before the US Supreme Court.

Yes, Obama does have display a copy of his birth certificate on his website. There have been allegations claiming that it is a forgery, but whether such claims are valid is one thing. Another is the fact that regardless, neither the certificate nor Obama’s own website state the name of any hospital, which is why I am asking for this question to be spread around.

Why hasn’t the media raised this question?  Why hasn’t anyone asked it to the Senator directly? If they were to do so, do you think he would provide an answer, and if so, why not?

I am not judging whether these allegations are true. I am simply asking a very fair and simple question that deserves a simple answer. What do the media and Obama have to hide?

So… anyone have an answer?
